The enforcement of court judgments in France

The main core of the law applicable in France on the channels of enforcement is the outcome of the reform introduced by a law of 9 July 1991. Under article 1 of the law, any creditor may, in the circumstances envisaged by the law, force a defaulting debtor to fulfil his obligations towards the creditor. According to article 2 of the above-mentionned law, a creditor who possesses an enforceable right establishing a claim for a debt that is fixed and due can carry out the enforcement on the debtor’s assets according to the conditions for each enforcement measure.

The intention of the project is to provide citizens with a description of the execution procedures applicable in France, including the role of the competent authorities responsible for execution.
